Terms of Service — Cain's Bedding & Waterbeds

These Terms of Service ("Terms") govern your use of the website cainsbeddingandwaterbeds.com and any purchases you make from Cain's Bedding & Waterbeds ("we," "us," "our"), located at 700 N. Delmar Ave, Hartford, IL 62048. By using our site or placing an order, you agree to these Terms.
1. Using our website
You may use our site for lawful personal or commercial shopping purposes only. You agree not to:
- Use the site in any way that could damage, disable, or impair it
- Attempt to gain unauthorized access to any part of the site or our systems
- Copy, scrape, or reproduce site content for commercial use without our written permission

2. Product information & pricing
We make every effort to display accurate product descriptions, images, and pricing. However, we do not warrant that product descriptions or other content are error-free, complete, or current.
Pricing errors: If a product is listed at an incorrect price due to a typographical error or system error, we reserve the right to refuse or cancel orders placed at the incorrect price, even after your order has been confirmed. We will notify you of the error and give you the option to reorder at the correct price or receive a full refund.
"Call for pricing" items: Some products — particularly waterbed systems and specialty items — are listed as "Request a Quote" and do not display a fixed price. These are sold at a price agreed upon between you and us before any order is finalized. No purchase obligation exists until you receive a written quote and confirm the order.
3. Orders & payment
By placing an order, you represent that you are at least 18 years old and authorized to use the payment method provided. All prices are in U.S. dollars.
We reserve the right to refuse or cancel any order for any reason, including product unavailability, suspected fraud, or errors in product or pricing information. If your order is cancelled after payment, you will receive a full refund.
Payment is processed securely through Shopify Payments. We do not store your full credit card number.
4. Shipping
Shipping terms, delivery timelines, and freight policies are described in our Shipping Policy, incorporated here by reference. Risk of loss and title for products purchased from us passes to you upon delivery to the carrier. We are not responsible for delays caused by carriers or circumstances outside our control.
5. Returns & refunds
Our return and refund policy is described in our Return & Comfort Guarantee Policy, incorporated here by reference. Illinois law treats an opened, slept-on mattress as secondhand — it cannot be resold. Please read our return policy carefully before purchasing.
6. Warranty
Products sold through our site are covered by the applicable manufacturer's warranty. We do not provide additional warranties beyond what the manufacturer offers. Warranty coverage is voided by misuse, improper installation, or damage not covered under the manufacturer's terms.
7. Intellectual property
All content on cainsbeddingandwaterbeds.com — including text, images, logos, graphics, and software — is owned by or licensed to Cain's Bedding & Waterbeds or its content suppliers and is protected by U.S. copyright and trademark law. You may not reproduce, distribute, or create derivative works without our express written permission.
Product images from manufacturers (Boyd, InnoMax, Spring Air, etc.) are the property of their respective owners and are used with permission as an authorized dealer.
8. Third-party links
Our site may contain links to third-party websites (manufacturer pages, financing partners, carrier tracking, etc.). We are not responsible for the content, accuracy, or privacy practices of those sites. Links do not imply endorsement.
9. Limitation of liability
To the maximum extent permitted by applicable law, Cain's Bedding & Waterbeds and its owners, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site or any products purchased here — including damages for loss of profits, data, or goodwill — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from your use of the site or a purchase shall not exceed the amount you paid for the product or service at issue.
Some states do not allow the exclusion of certain warranties or limitation of liability — those exclusions may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Cain's Bedding & Waterbeds and its officers, employees, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the site, your violation of these Terms, or your violation of any third party's rights.
